{"id":21248,"date":"2023-03-27T12:40:56","date_gmt":"2023-03-27T10:40:56","guid":{"rendered":"https:\/\/suport.fundesplai.org\/blog-es\/actualidad\/que-hay-que-saber-sobre-la-ley-de-salud-sexual-y-reproductiva\/"},"modified":"2023-05-17T13:31:01","modified_gmt":"2023-05-17T11:31:01","slug":"que-hay-que-saber-sobre-la-ley-de-salud-sexual-y-reproductiva","status":"publish","type":"post","link":"https:\/\/suport.fundesplai.org\/es\/blog-es\/laboral-es\/igualdad\/que-hay-que-saber-sobre-la-ley-de-salud-sexual-y-reproductiva\/","title":{"rendered":"\u00bfQu\u00e9 cambios laborales supone la ley de salud sexual y reproductiva?"},"content":{"rendered":"<p>La\u00a0<a href=\"https:\/\/www.boe.es\/buscar\/act.php?lang=es&amp;id=BOE-A-2023-5364&amp;tn=1&amp;p=\" target=\"_blank\" rel=\"noopener\">Ley Org\u00e1nica 1\/2023, de 28 de febrero<\/a>, es la nueva normativa que modifica la\u00a0<a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2010-3514\" target=\"_blank\" rel=\"noopener\">Ley Org\u00e1nica 2\/2010, del 3 de marzo, de salud sexual y reproductiva y de la interrupci\u00f3n voluntaria del embarazo<\/a>. Esta ley conocida como la <strong>\u2018ley del aborto<\/strong>\u2019 tiene la finalidad de garantizar los derechos fundamentales relacionados con la\u00a0<strong>salud sexual<\/strong>\u00a0y\u00a0<strong>reproductiva<\/strong>. La nueva normativa, que entrar\u00e1 en vigor el <strong>1 de junio de 2023<\/strong> regula aspectos de \u00e1mbito laboral que las entidades tienen que tener presente. En caso de necesitar apoyo sobre\u00a0esta cuesti\u00f3n u otra, nuestro <a href=\"https:\/\/suport.fundesplai.org\/es\/servicios\/laboral\/\" target=\"_blank\" rel=\"noopener\">servicio laboral<\/a> estar\u00e1 encantado en ayudar.<\/p>\n<h3>Nuevas situaciones de incapacidad temporal<\/h3>\n<p>En primer lugar, se reconoce como una situaci\u00f3n especial de <strong>incapacidad temporal<\/strong>\u00a0por\u00a0contingencias comunes la baja laboral causada por una\u00a0<strong>menstruaci\u00f3n incapacitante\u00a0<\/strong>secundaria o\u00a0<strong>dismenorrea<\/strong> secundaria\u00a0asociada a\u00a0<strong>patolog\u00edas\u00a0<\/strong>previamente <strong>diagnosticadas<\/strong>. Con esta modificaci\u00f3n se pretende regular<strong>\u00a0situaciones patol\u00f3gicas\u00a0<\/strong>con el fin de eliminar cualquier tipo de\u00a0prejuicio\u00a0negativo en el <strong>\u00e1mbito laboral<\/strong>. Igualmente, queda reconocida como otra situaci\u00f3n especial de incapacidad temporal por contingencias comunes la\u00a0interrupci\u00f3n del embarazo, sea voluntaria o no, siempre que se reciba\u00a0asistencia sanitaria\u00a0por el\u00a0<strong>Servicio P\u00fablico de Salud<\/strong>\u00a0y haya impedimento para llevar a cabo el trabajo. Finalmente, la \u00faltima situaci\u00f3n especial de incapacidad temporal por contingencias comunes es por\u00a0gestaci\u00f3n, desde el primer d\u00eda de la\u00a0<strong>semana treinta y nueve<\/strong>.<\/p>\n<h3>C\u00f3mo aplicar las situaciones especiales de incapacidad temporal<\/h3>\n<p>Las circunstancias que se han explicado antes son situaciones de<strong> incapacidad temporal\u00a0<\/strong>por\u00a0<strong>contingencias comunes<\/strong>. Solo se tratar\u00e1 de una incapacidad temporal por\u00a0<strong>contingencias profesionales<\/strong>\u00a0en el caso de que la interrupci\u00f3n del embarazo sea ocasionada por un\u00a0<strong>accidente laboral\u00a0<\/strong>o enfermedad profesional. En cuanto a las bajas m\u00e9dicas por\u00a0menstruaci\u00f3n incapacitante secundaria, cada proceso se considerar\u00e1 como uno nuevo,\u00a0<strong>sin computar<\/strong>\u00a0los periodos m\u00e1ximos de duraci\u00f3n de la situaci\u00f3n de incapacidad temporal. Hay que recalcar que no se exigir\u00e1n periodos m\u00ednimos de cotizaci\u00f3n en este caso. Aun as\u00ed, en la situaci\u00f3n especial de\u00a0<strong>gestaci\u00f3n de personas<\/strong> <strong>trabajadoras<\/strong>, desde el primer d\u00eda de la semana treinta y nueve. S\u00ed que se exigir\u00e1 que la persona interesada acredite los periodos m\u00ednimos de cotizaci\u00f3n, seg\u00fan el<a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11724&amp;p=20230301&amp;tn=1#a178\" target=\"_blank\" rel=\"noopener\"> art\u00edculo 178.1 de la Ley General de la Seguridad Social<\/a>, en funci\u00f3n de la edad en el momento del inicio del descanso.<\/p>\n<h3>Cotizaci\u00f3n de la Seguridad Social<\/h3>\n<p>En referencia a la\u00a0<strong>cotizaci\u00f3n<\/strong>, ser\u00e1 la<strong>\u00a0Seguridad Social\u00a0<\/strong>la encargada de asumir el\u00a0<strong>subsidio\u00a0<\/strong>desde el primer d\u00eda de la baja por la menstruaci\u00f3n incapacitante secundaria. Cuando se trata del resto de las enfermedades comunes se hace a partir del tercer d\u00eda. As\u00ed mismo, en las situaciones especiales por la interrupci\u00f3n del embarazo y de incapacidad temporal por gestaci\u00f3n, la <strong>Seguridad Social<\/strong>\u00a0se har\u00e1 cargo de la prestaci\u00f3n desde el d\u00eda siguiente a la baja laboral.
